AKTUELLE REGEL: Recording amounts placed on the market (input)

1. Subject of regulation

This rule determines the procedure on reporting amounts placed on the market.

2. Background

Registered producers and authorised representatives (§ 3 no. 10 ElektroG) are legally obligated to regularly report the amounts named in § 27 ElektroG to the Gemeinsame Stelle online via the ear-portal, or respectively via an electronic data interface (SOAP). Aim of this amount report  obligation is especially to determine the producer’s and authorised representative’s (§ 3 no. 10 Elektro) take-back obligation of waste equipment, as well as to create a data basis for reporting to the German Environment Agency.

3. Regulation

3.1 Amount reports 

In principle, producers and authorised representatives (§ 3 no. 10 ElektroG) alone are responsible for the accuracy of the data. Stiftung ear can demand that reported amounts according to § 27 paragraph 1 clause 1 ElektroG are confirmed by an independent expert (§ 27 paragraph 3 clause 3 ElektroG). The storage period for such documentation is valid according to GOB, § 147 Abgabenordnung (tax code). 

3.2 Determining the amounts to be reported

The delivery scope which has to be included in the report of electrical and electronic equipment placed on the market can be viewed in the following table.

If not determined otherwise, the following delivery scope which has to be considered applies to the categories 1-6:

 

For the input report: The weight of the equipment in a usable or respectively ready-for-operation state, i.e. in the basic set-up of the delivery state. This does not contain:

  • packaging
  • accompanying documents
  • additional accessories/additions that do not contain electronic components (e.g. cases, bags) 
  • consumables (e.g. CD, DVD)
  • accumulators/batteries (regardless whether permanently installed or easily removable)

The disposers are obligated to remove batteries/accumulators from the equipment and to have them picked up and recovered by the battery collection scheme free of charge. The disposers prove these amounts (monitoring).
